The Gujarat Consumer Disputes Redressal Commission (GCDRC), found Rajkot-based Atmiya Institute of Technology and Science (AITS) guilty of unfair trade practice after the college refused to return the certificates and refund the fees of Peter Alwin.

AITS has been ordered to refund Rs 15,000, the fees for second semester, and caution money of Rs 2,000. The college will also have to compensate Peter with Rs 7,000 for the mental harassment caused and Rs 3,000 towards legal cost.

Peter Alwin, 26, a graduate from National Institute of Design (NID) had taken admission to AITS in October 2004.

Six months later he got admission to NID and wanted his admission to AITS cancelled. “I had paid Rs 30,000 for the first year at AITS. I requested them to cancel my admission. However, they didn’t respond to my requests till 2007. Then, they demanded Rs 1 lakh, the full fee for the four-year course, as a pre-condition to return my original documents,” said Alwin. He took admission to NID by submitting provisional certificates.

Based on Alwin’s complaint, the Rajkot Consumer Disputes Redressal Additional Forum on August 7, 2010, ordered the college to return all the original documents of Peter Alwin within 30 days from the order date. However, AITS appealed against the forum’s order.

On October 17, the commission dismissed the college’s appeal and stated that the institute indulged in unfair trade practice by demanding Rs 1,00,000 towards four-years’ fees and holding Alwin’s original documents in its custody as if it has got ‘legal claim’ over them.

Reacting to the commission’s order, Alwin said, “I am relieved to get my documents back from AITS after almost seven years. I am yet to get the monetary compensation.”

Alwin recently got placed with Electrolux in Sweden.
